Pango.Q Terms of Service & Privacy Policy
These Terms of Service ("Terms") are a binding legal agreement between you and Pango Quest (Pango.Q) that govern the right to use the websites, applications, and other offerings from Pango Quests (collectively, the "Pango.Q Platform"). When used in these Terms, "Pango.Q," "we," "us," or "our" refers to the Pango Quests entity with whom you are contracting.
The Pango.Q Platform enables users ("Questers") to search for, create groups, book and pay for various services (Quests), which fall under the categories of Holidays, Tickets, Excursions and Events.
About Pango.Q
When you book a quest – holiday, ticket, excursion or event – Pango.Q is responsible for the Platform but not the Experience itself. We work with partners that curate and manage the experiences.
We get information from our partners, the Quest Providers, and we can't guarantee that everything is accurate but when providing them on our Platform, we take reasonable care and act with professional diligence. Unless we've failed to do so or have been negligent, we can't be held responsible for any errors, interruptions, or missing bits of information. Of course, we'll do everything we can to correct/fix them as soon as we become aware.
Our Platform is not a recommendation or endorsement of any quest provider or its products, services, facilities, etc. We are not a party to the terms between you and the quest provider; the quest provider is solely responsible for the quest experience.
To make a booking, you will need to create an Account. Please make sure all your info (including payment and contact details) is correct and up to date, or you might find you can't access your Quest(s).
We will show you the offers available to you in (what we think is) the right language for you. You can change to another language whenever you like.
Unless otherwise indicated, you must be at least 18 to use the Platform.
User Accounts
You must register an account to access and use many features of the Pango.Q Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older.
You must provide accurate, current, and complete information during the account creation process and keep your account information up-to-date.
You may not transfer your account to someone else.
You are responsible for maintaining the confidentiality of your account credentials (password and any other access information) and for all activities that occur under your account. Do not let anyone else use it, and ensure to keep your account credentials (username and password) secret. Immediately notify Pango.Q if you suspect that your credentials have been lost, stolen, or if your account is otherwise compromised.
If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.
Pango Quest reserves the right to suspend or terminate Quester accounts at its sole discretion, without prior notice, for any reason, including but not limited to a breach of these Terms.
Portal Use
You will comply with all applicable laws regulating the use of Pango Quests and will cooperate with any anti-fraud/anti-money laundering checks that may need to be carried out. You will not use the Platform to cause a nuisance or make fake bookings, and will use the quests experiences and/or Platform for their intended purpose.
Based on your interaction with our Platform and your preferences, we may enable features intended to make your experience more convenient and offer you tailored services (including personalized marketing messages) to enhance your experience and make it easier for you to book your ideal quest.
We'll always be working to improve our customers' experience; so, sometimes, we will show different people different designs, phrasings, products, etc., to find out how they react. As a result, you might not come across some services or conditions when you visit our Platform.
Searching
You can search for quests by using criteria like the type of travel / holiday destination, type of tickets, events or excursion. You can also use filters to refine your search results.
Booking
The Portal allows you to book various "Quests," including holiday offers, tickets (flights, buses, trains), excursions and events (personal, public, corporate). When booking a Quest, you are responsible for ensuring the accuracy of all information provided, including dates, times, participant details, and any other required information.
When you make a booking, you agree to pay the cost of the quest, including any charges and taxes that may apply.
You can book quests as an individual or create a group of fellow questers. You have a right to accept or decline to be added to a quest group.
Obvious errors and obvious misprints are not binding. E.g., if your quest is mistakenly offered for Ksh1, your booking will be cancelled, and we'll refund anything you've paid. We will remove obvious pricing errors as soon as we become aware. A crossed-out price indicates the price of a like-for-like booking without the price reduction applied ('like-for-like' means same dates, same policies, same quality of quest).
Quest Group Creators are responsible and liable for their own acts and omissions and are also responsible for the acts and omissions of anyone they invite to join the quests (s). If you book a Quest on behalf of additional questers, you are required to ensure that every additional quester meets any requirements set by Quest Planners and is made aware of and agrees to these Terms and any terms and conditions, rules and restrictions set by the Quest Planner.
If you are booking for an additional guest who is a minor or if you bring a minor to a Quest, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.
You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, they assume the entire risk arising out of their access to and use of the Pango.Q Platform and any Content including their access to any of the quests, or any other interaction they have with other questers whether in person or online. This means it is your responsibility to investigate a Quest to determine whether it is suitable for you. For example, Quests, like some excursions, may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those quests.
Payment
Payment for Quests will be processed through the payment methods specified on the Portal, which may include MPESA, Pesalink, and Cards.
By providing payment information, you represent and warrant that you are authorized to use the designated payment method.
The total cost of the Quest, including any applicable taxes and fees, will be displayed to the Quester before confirmation of the booking.
Payment in the Pango.Q platform constitutes payment in installments for the selected quests(s). The total price of the quest will be indicated upon booking and the installments will be determined by the date you want to access the quest or the day of the event.
Pango Quest's payment process involves the Quester selecting the Quest to pay for, entering the Quest's name, and making payment. A receipt message will be sent via SMS and email upon successful installment payment.
All payments are processed in KSh (Kenyan Shilling). If your payment method uses a different currency, your bank or payment provider may charge additional fees. If this happens, we'll inform you during the booking process.
If you know of or suspect any fraudulent behavior or unauthorized use of your Payment Method, please contact your payment provider as soon as possible. Pango.Q (or, in some cases, our booking partners) will be responsible for managing your booking payment and ensuring the completion of your transaction with the quest provider(s), in as along as your installment payments constitute the final settlement of the 'due and payable' price.
You can view real-time statements for your Quests, including amounts paid and balances. For group Quests, statements will also show what each member has paid and the remaining balance.
You agree that you will not receive interest or other earnings on the funds held in your Escrow Account. If any interest is earned then you agree that all interest is assigned to Pango.Q. In no event will you receive any interest earnings, including if the quest or payment fails, is canceled, or escrow funds are returned to you. Any interest accrued in an escrow trust account may be retained in the interest-bearing escrow account until the end of the current calendar month.
Pango.Q, Pango.Q Escrow, or our Affiliates may charge or deduct fees, may receive a reduction in fees or expenses charged, and may receive other compensation in connection with the services we provide.
Cancellation
If you cancel a quest, the amount refunded to you is determined by the quest provider's cancellation policy, which will be provided with each quest booking and will take a minimum sixty (6o) days to process. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control forces you to cancel a booking, you may be eligible for a partial or full refund under our Major Disruptive Events Policy. If the Quest provider cancels, or you experience a booking Issue, you may be eligible for rebooking assistance or a partial or full refund.
Once a quest has been cancelled, the quester can choose to either receive the amount in cash QR transfer it to another quest QR have the amount Credited to their Quest Account for future use.
Booking Modifications
Questers and Quest Providers are responsible for any booking modifications they agree to make via the Pango.Q Platform or direct Pango.Q customer service to make on their behalf ("Booking Modifications"), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification.
User Conduct
You agree to use the Portal only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Portal.
Questers must not:
- Use the Portal in any way that could damage, disable, overburden, or impair the Portal or interfere with any other party's use of the Portal.
- Attempt to gain unauthorized access to any part of the Portal, other accounts, computer systems, or networks connected to the Portal.
- Use the Portal to transmit any viruses, worms, malware, or other harmful code.
- Collect or harvest any personally identifiable information from the Portal without the express written consent of Pango Quest.
- Impersonate any person or entity or falsely state or otherwise misrepresent their affiliation with a person or entity.
- Engage in any activity that could be considered fraudulent or illegal.
Intellectual Property
The Portal and its original content, features, and functionality (including but not limited to text, graphics, logos, images, software) are and will remain the exclusive property of Pango Quest and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Portal for your personal, non-commercial use in accordance with these Terms. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Portal, except as generally and ordinarily permitted through the Portal according to these Terms.
Privacy
The collection and use of your personal information is governed by Pango Quest's Privacy Policy, which is incorporated into these Terms by reference. You are encouraged to review the Privacy Policy.
Communications
By creating an account, you consent to receive communications from Pango Quest, including but not limited to:
- Reminder emails to complete pending profile applications.
- Email and SMS notifications for successful completion of a Quest booking.
- Reminder emails to update profile information where necessary.
- Other service-related announcements and promotional materials.
You can manage their communication preferences through their account settings where applicable.
Disclaimer of Warranties
The Portal is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Pango Quest does not warrant that the Portal will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Pango Quest makes no warranties or representations about the accuracy or completeness of the content provided on the Portal or the services offered through it.
Limitation of Liability
To the maximum extent permitted by applicable law, Pango Quest shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to the Quester's access to or use of, or inability to access or use, the Portal, even if Pango Quest has been advised of the possibility of such damages.
Pango Quest's total liability to the Quester for any claim arising out of or relating to these Terms or the use of the Portal shall not exceed the total amount paid by the Quester to Pango Quest in the twelve (12) months preceding the event giving rise to the liability.
Indemnification
You agree to indemnify, defend, and hold harmless Pango Quest and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to their breach of these Terms, their use of the Portal, or their violation of any law or the rights of a third party.
Term
The agreement between you and Pango.Q reflected by these Terms is effective when you access the Pango.Q Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.
Termination
You may terminate this agreement at any time by sending us an email or by deleting your account. Pango.Q may terminate this agreement and your account for any reason by providing you 30 days' notice via email or using any other contact information you have provided for your account. Pango.Q may also terminate this agreement immediately and without notice and stop providing access to the Pango.Q Platform if you breach any of the provided Terms of use, you violate applicable laws, or we reasonably believe termination is necessary to protect Pango.Q, its Members, or third parties. If your account has been inactive for more than two years, we may terminate your account without prior notice.
Pango.Q reserves the right to change our services, including to add or remove features and functionalities or change the types of guests we accept or allow on the platform, including but not limited to: improve or update our services, prevent abuse, or respond to legal requirements.
Modification of Terms
Pango.Q may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Pango.Q Platform and update the "Last Updated" date at the top of these Terms. We will also provide you with notice of any material changes by email, notifications through the Pango.Q Platform, messaging service, or any other contact method made available by us and selected by you at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Pango.Q Platform will constitute acceptance of the revised Terms.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms, or the use of the Portal shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.
Entire Agreement
These Terms constitute the entire agreement between you and Pango Quest regarding the use of the Portal and supersede all prior and contemporaneous agreements, understandings, and communications, whether oral or written.
